Requested Criminal Investigation on 13 July 2021
Subject: regarding the cancelled court-requested mental assessment of 31 May 2021
2. Did the defendant uphold the Constitutional right of all mental patients when he politely advised the psychiatrist that a mental assessment should not obligate a physical assessment, or did the psychiatrist unwittingly allow the hospital to deny patients the freedom of religious belief on 31 May 2021?
A Criminal Investigation is necessary.
During the court hearing on 13 July 2021, the court accepted a request of a Criminal Investigation concerning a crucial assessment of the defendant's mental state. The psychiatrist asserts the defendant refused the physical (and therefore also mental) assessment. The defendant asserts he did not decline the mental assessment (but only the physical) assessment, because thinking does not originate in the body according to the idea of the existence of a commonly shared eternal mind. The defendant claims the doctor effectively required the defendant to give up religious belief in an eternal Spirit as the ever-lasting source of mental wellness before the so-called "hospital protocol" allowed the psychological assessment to occur. The date of the mental assessment was 31 May 2021.

At 9:29:31 AM, Chun-Hung Lee (李俊宏) told the defendant (Rene, 瑞內) that a forensic psychologist, not a psychiatrist, is going to conduct the mental part of the mental assessment:
57:56 [9:29:12 AM] Lee: So, in
58:10 [9:29:26 AM] Rene: And you're not willing to do only the mental part?
58:15 [9:29:31 AM] Lee: Yah, that's for the Forensic Psychologist. Ok?
Please refer to the next page. A copy of the original assessment schedule (the day's itinerary) is attached. It shows that the mental assessment (the actual determination of a person's ability to judge) is conducted at 10:30:
At 9:29:59 AM, Chun-Hung Lee (李俊宏) told the defendant that the defendant will meet the psychologist at 10:30 AM in order to complete the court-requested mental assessment:
58:35 [9:29:51 AM] Rene: Oh, so I can't do this stuff with you, but I can do this stuff with the psychologist.
58:40 [9:29:56 AM] Rene: At 10:30, I meet with the psychol--sorry, psychiatrist.
58:43 [9:29:59 AM] Lee [pointing to the itinerary]: Psychologist here (scheduled at 10:30 in the itinerary), I'm the psychiatrist (scheduled at 9:15 in the itinerary).
58:46 [9:30:02 AM] Rene: You're the psychiatrist?
58:48 [9:30:04 AM] Lee: I'm the psychiatrist.
This man is different from other psychiatrists that the defendant met. Previous psychiatrists ignored the statements from the defendant inferring belief that thinking cannot originate in a physical substance. Chun-Hung Lee (李俊宏) was far more aggressive, and assertive of the belief that everyone does not share a common living eternal Spirit. After all, if everyone ultimately shares an eternal spirit, then the body does not at all determine the mental health of an individual.
At 9:30:04 AM (58 minutes and 48 seconds from the start of the recording), the psychiatrist answers the defendant's remark from 9:29:51 AM (58 minutes 35 seconds from the start). The psychiatrist specifically asserts that the defendant is incorrect about the defendant's iron-clad conviction about the existence of a commonly shared singular eternal spirit (a spirit that can perform miracles, and cure absolutely any physical illness irrespective of the laws of nature):
58:48 [9:30:04 AM] Lee: But some mental states will be affected by the physical condition.
59:00 [9:30:16 AM] Rene: That's incorrect. It doesn't need to be.
59:01 [9:30:17 AM] Lee: Such as adrenal efficiency.
59:04 [9:30:20 AM] Rene: It doesn't need to be.
59:05 [9:30:21 AM] Lee: [scoffs]
59:05 [9:30:21 AM] Rene: And we have a difference of opinion about that so
59:10 [9:30:26 AM] Lee: Ya, ya, ya, so--
59:11 [9:30:27 AM] Rene: If you're not willing to continue doing a mental assessment with me, without the physical part, that's your belief.
59:20 [9:30:36 AM] Lee: Ya, ya
59:21 [9:30:37 AM] Rene: And you believe you can't do it.
After a short conversation, Chun-Hung Lee (李俊宏) decided he did not want to argue. Chun-Hung Lee (李俊宏) cited "hospital protocol" as grounds of being unable to proceed with a mental assessment.
59:22 [9:30:38 AM] Lee: And it's our code.
59:22 [9:30:38 AM] Rene: Right
59:22 [9:30:38 AM] Lee: And it's our protocol here. So, if you do not want to do that. We can tell the court you do not want to do the laboratory examination and the whole protocol, and the whole process including [included] in our protocol, and they will refer [you] to another institution or facility, which would like do only mental state examination for you.
59:56 [9:31:12 AM] Rene: As long as you write that, we completely agree.
59:57 [9:31:13 AM] Lee: mmm [means "Yes" in Chinese]
59:58 [9:31:14 AM] Rene: We agree, but, you don't say that I don't want to do it. [You can't say that I don't want to do it.] I do want to do it. But I believe I am not my body. I believe in Spirit.
1:00:06 [9:31:22 AM] Lee: Ok.
1:00:07 [9:31:23 AM] Rene: So, in order to talk to the mind, I--you believe that the mind comes from the body--I believe the other way. I believe the body comes from the mind.
1:00:16 [9:31:32 AM] Lee: That's ok. That's ok.
1:00:17 [9:31:33 AM] Rene: So just as long as you--
1:00:18 [9:31:34 AM] Lee: Yes
1:00:18 [9:31:34 AM] Rene: --write down the laboratory part--
1:00:20 [9:31:36 AM] Lee: Yah, yah, yah, ok. We can write down all these arguments and mail to the court, and maybe they will assign another facility.
However, the defendant had already asked to see a copy of the "hospital protocol", to evaluate whether the hospital rule was in accord with Constitutional Laws. In fact, because the defendant understands that nothing in an ever-changing environment can ever be real, the defendant was completely certain that the cited "Hospital protocol" was very much against the Constitutional freedom of religious belief. Unlike before, this time the defendant had the conversation audio-recorded:
56:40 [9:27:56 AM] Lee: Ok?
56:40 [9:27:56 AM] Rene: Ah, no.
56:41 [9:27:57 AM] Rene [speaking very clearly]: Because I DO want the assessment, so let's continue the assessment.
56:46 [9:28:02 AM] Lee: But we can't, [chuckle], we can't forward the further assessment until you complete all the assessment.
56:56 [9:28:12 AM] Rene: Noooo, that's not correct. Do you have a--can you show me the rule?
57:00 [9:28:16 AM] Lee: Yeah, we have the protocol here.
57:04 [9:28:20 AM] Rene: Ok, can you show me the protocol?
57:05 [9:28:21 AM] Lee: But it's all in Chinese.
57:06 [9:28:22 AM] Rene: That's Ok.
57:07 [9:28:23 AM] Lee leaves back to a counter not far away. In Chinese, in the background, he asks the receptionist to give him something.
57:18 Rene to Special Interpreter Nelson (侯至和): Are these three letters his full Chinese name?
57:21 Nelson [can't really be heard as the doctor returned]: Yes.
57:21 Rene: Can you read all three?
57:21 Nelson: Yes.
57:23 [9:28:39 AM] Lee [returns in a flurry]: But... but, but, uh, but you don't want to do the assessment here?
57:30 [9:28:46 AM] Rene: No, I definitely want to do the assessment here. Yes I want to do the assessment.
The psychiatrist told the defendant that another hospital could probably do the assessment, and the psychiatrist told the defendant that this hospital has all of the people available to completely the psychological assessment. The psychiatrist was only telling the defendant to go away. There is a Criminal Code, Article 294, which obligates doctors to treat severely ill people and not turn their back on people who are severely suffering in an extreme state of Delusion.
At 9:39:34 AM, Chun-Hung Lee (李俊宏) said "Have a nice day" as goodbye to the defendant. The whole conversation with the psychiatrist lasted about 13 minutes.
The defendant recounts:
I assure you that I did not decline the court-requested assessment. It was my idea to request the assessment because nine psychiatrists previously diagnosed me with severe psychosis, Schizophrenia, Schizoaffective Disorder, Bipolar Disorder and Delusional Disorder.
I did audio-record the entire conversation with the doctor on 31 May 2021. And I transcribed the whole conversation into a PDF document in order to review whether or not I am delusional. At exactly 9:30 AM on 31 May 2021 I specifically told 衛生福利部嘉南療養院 psychiatrist Chun-Hung Lee (李俊宏): "you don't say that I don't want to do it (the mental assessment). I do want to do it. But I believe I am not my body. I believe in Spirit."
In the court hearing on 13 July 2021, I submitted the entire record to the Tainan District Court in the above file (also listed in the bottom-left corner of each page in this document as a PDF). This document is copied onto the internet, to promote general awareness about unethical psychiatric practices.
The psychiatrist and I were specifically talking about the origin of thinking (of thoughts in general):
The psychiatrist believes the thinking originates in the brain, or some other part of our physical body. But I believe in God. I believe that God made us. And, since God is eternal, what God makes must be eternal like himself. Therefore, I have an eternal spirit. If I have an eternal spirit, that means I won't die when my body dies. If I don't die when my body dies, that means I retain self-awareness after my body dies. If I retrain self-awareness after my body dies, then I am still thinking after my body dies. In conclusion, the origin of my thinking cannot be from anywhere in my body.
Basically, the psychiatrist asked me to give up my belief in God before the psychiatrist was willing to conduct the court-requested mental assessment. The psychiatrist also told me that, actually, a different doctor is scheduled to conduct the mental assessment at 10:30 am, but "hospital protocol" says that I am not allowed to retain my faith in Spirit (or God). Then he told the court that I refused.
I claim that what the psychiatrist did is a violation of the Constitutional right to really believe in God! And I asked the Criminal Court to investigate that on 13 July 2021! I'm very curious whether they will agree that I must give up my faith in God, or If I can keep my faith in God. Because, if I can keep my faith in God, which means that I don't need a physical examination in order to complete the court-requested mental assessment, then the letter from Jainan Psychiatric Center (衛生福利部嘉南療養院) Dean Wu Wenzheng (院長吳文正) dated 2 June 2021 is incorrect!
The letter dated 2 June 2021 from Dean Wu Wenzheng (院長吳文正) states:
Subject: Check and return the appraisal dossier data of Defendant HELMERICHS‧RENE (Chinese name: Shi Rene) in the 108th v. No. 1170. Please refer to it for details.
1. Fuguiyuan's letter dated April 1, 2021, No. 110011570 of the Nanyuan Military Penalty Years 108 Yi 1170.
2. The hospital arranged for the appraisal to be carried out on May 31, 110 (Monday), but it was announced that the case refused to accept the laboratory examination items (blood, urine, brain wave and other examinations) on the day of the appraisal, and stated that it was in another country. There is no need to perform inspection and inspection items, and the forensic psychiatrist can directly conduct the assessment meeting, so the appraisal arrangement process of this hospital is rejected.
3. After careful evaluation by this court, the case refused to cooperate with the appraisal process items, so the relevant materials of the case were checked and returned to facilitate the transfer of mental appraisal to other locations.
謹 狀 | Sincerely, that's all.
Kidsland claims they fired
me on 25 Jan 2018... but I have emails proving we agreed that I would take
leave to have a mental assessment. We're
going to need a Criminal Investigation why a doctor declined a Delusional
individual a mental assessment. Or we're
going to need a Criminal Investigation why cram school managers claimed to fire
me, when we agreed that I would be on unpaid vacation while getting my mental
state assessed. In both cases,
