說明：
Description:
一、衛生福利部嘉南療養院在醫院願意提供心理健康評估前，要求精神病人進行身體評估，是否違反了中華民國憲法第十三條「信仰宗教之自由」？
二、110年5月31日，被告禮貌地建議精神科醫生不應強制進行身體評估時，是否維護了所有精神病人的憲法權利，還是精神科醫生在不知情的情況下允許醫院剝奪患者的宗教信仰自由？
刑事調查是必要的。

2. Did the defendant uphold the Constitutional right of all
mental patients when he politely advised the psychiatrist that a mental
assessment should not obligate a physical assessment, or did the psychiatrist
unwittingly allow the hospital to deny patients the freedom of religious belief
on 31 May 2021?
A Criminal Investigation is necessary.

During the court hearing on 13 July 2021,
the court accepted a request of a Criminal Investigation concerning a crucial
assessment of the defendant's mental state.
The psychiatrist asserts the defendant refused the physical (and
therefore also mental) assessment. The
defendant asserts he did not decline the mental assessment (but only the
physical) assessment, because thinking does not originate in the body according
to the idea of the existence of a commonly shared eternal mind. The defendant claims the doctor effectively
required the defendant to give up religious belief in an eternal Spirit as the
ever-lasting source of mental wellness before the so-called "hospital
protocol" allowed the psychological assessment to occur. The date of the mental assessment was 31 May
2021.

psychologist at 10:30 AM in order to complete the court-requested mental
assessment:

This man is different from other psychiatrists that the
defendant met. Previous psychiatrists
ignored the statements from the defendant inferring belief that thinking cannot
originate in a physical substance.
Chun-Hung Lee (李俊宏) was far more aggressive, and assertive of the belief that
everyone does not share a common living eternal Spirit. After all, if everyone ultimately shares an
eternal spirit, then the body does not at all determine the mental health of an
individual.

minutes 35 seconds from the start). The
psychiatrist specifically asserts that the defendant is incorrect about the
defendant's iron-clad conviction about the existence of a commonly shared
singular eternal spirit (a spirit that can perform miracles, and cure
absolutely any physical illness irrespective of the laws of nature):

After a short conversation, Chun-Hung Lee (李俊宏) decided he
did not want to argue. Chun-Hung Lee (李俊宏) cited
"hospital protocol" as grounds of being unable to proceed with a
mental assessment.

examination for you.

However, the defendant had already asked to see a copy of the
"hospital protocol", to evaluate whether the hospital rule was in
accord with Constitutional Laws. In
fact, because the defendant understands that nothing in an ever-changing
environment can ever be real, the defendant was completely certain that the
cited "Hospital protocol" was very much against the Constitutional
freedom of religious belief. Unlike
before, this time the defendant had the conversation audio-recorded:

[9:28:46 AM] Rene: No, I definitely want to do the assessment here. Yes I want to do the assessment.
精神科醫生告訴被告，另一家醫院可能可以做評估，精神科醫生告訴被告，這家醫院有所有的人可以做完整的心理評估。精神科醫生只是告訴被告走開。刑法第294條規定，醫生有義務治療重病患者，不得對處於極端妄想狀態而遭受嚴重痛苦的人置之不理。
The psychiatrist told the defendant that another hospital could
probably do the assessment, and the psychiatrist told the defendant that this
hospital has all of the people available to completely the psychological
assessment. The psychiatrist was only
telling the defendant to go away. There
is a Criminal Code, Article 294, which obligates doctors to treat severely ill
people and not turn their back on people who are severely suffering in an
extreme state of Delusion.

At 9:39:34 AM, Chun-Hung Lee (李俊宏) said "Have a nice day" as goodbye to the
defendant. The whole conversation with
the psychiatrist lasted about 13 minutes.

The defendant recounts:
我向您保證，我沒有拒絕法院要求的評估。我的想法是要求進行評估，因為之前有九位精神科醫生診斷出我患有嚴重的精神病、精神分裂症、分裂情感性障礙、雙相情感障礙和妄想症。
I assure you that I did not decline the court-requested
assessment. It was my idea to request
the assessment because nine psychiatrists previously diagnosed me with severe
psychosis, Schizophrenia, Schizoaffective Disorder, Bipolar Disorder and
Delusional Disorder.
我在110年5月31日對與醫生的整個談話進行了錄音。我將整個談話轉錄成PDF文件，以檢查我是否有妄想症。110年5月31日上午9點30分，我特意告訴衛生福利部嘉南療養院精神科醫生李俊宏：「你不能說我不想做（心理評估）。我很想做。但我相信我不是我的身體。我相信聖靈。」
I did audio-record the entire conversation with the doctor on 31
May 2021. And I transcribed the whole
conversation into a PDF document in order to review whether or not I am
delusional. At exactly 9:30 AM on 31 May
2021 I specifically told 衛生福利部嘉南療養院 psychiatrist Chun-Hung Lee (李俊宏): "you don't say that I don't want
to do it (the mental assessment). I do
want to do it. But I believe I am not my
body. I believe in Spirit."
在110年7月13日的聽證會上，我將上述文件中的全部記錄提交給台南地方法院（也在本文件每頁的左下角以PDF格式列出）。該文件被複製到互聯網上，以提高對不道德的精神病行為的普遍認識。
In the court hearing on 13 July 2021, I submitted the
entire record to the Tainan District Court in the above file (also listed in
the bottom-left corner of each page in this document as a PDF). This document is copied onto the internet, to
promote general awareness about unethical psychiatric practices.

The psychiatrist and I were specifically talking about
the origin of thinking (of thoughts in general):
精神病學家認為思維起源於大腦或我們身體的其他部分。但我相信上帝。我相信上帝創造了我們。而且，既然上帝是永恆的，那麼上帝創造的東西就必須像他自己一樣永恆。因此，我有一個永恆的精神。如果我有一個永恆的精神，那就意味著我的身體死了我也不會死。如果我的身體死了我不死，那就意味著我在我的身體死後保留了自我意識。如果我在我的身體死後重新訓練自我意識，那麼我在我的身體死後還在思考。總之，我思想的起源不可能來自我身體的任何地方。
The psychiatrist believes the thinking originates in
the brain, or some other part of our physical body. But I believe in God. I believe that God made us. And, since God is eternal, what God makes
must be eternal like himself. Therefore,
I have an eternal spirit. If I have an
eternal spirit, that means I won't die when my body dies. If I don't die when my body dies, that means I
retain self-awareness after my body dies.
If I retrain self-awareness after my body dies, then I am still thinking
after my body dies. In conclusion, the
origin of my thinking cannot be from anywhere in my body.
基本上，在精神科醫生願意進行法庭要求的心理評估之前，精神科醫生要求我放棄對上帝的信仰。精神科醫生還告訴我，實際上，上午10:30安排了另一位醫生進行心理評估(李思穎心理師)，但「醫院協議」說我不能保留對精神（或上帝）的信仰。然後他告訴法庭我拒絕了。
Basically, the psychiatrist
asked me to give up my belief in God before the psychiatrist was willing to
conduct the court-requested mental assessment.
The psychiatrist also told me that, actually, a
different doctor is scheduled to conduct the mental assessment at 10:30 am, but
"hospital protocol" says that I am not allowed to retain my faith in
Spirit (or God). Then he told the court
that I refused.
我聲稱精神科醫生的所作所為違反了憲法規定的真正信仰上帝的權利！我要求刑事法庭在110年7月13日對此進行調查！我很好奇他們是否會同意我必須放棄對上帝的信仰，或者我是否可以保持對上帝的信仰。因為，如果我能保持對上帝的信仰，那就意味著我不需要體檢就可以完成法庭要求的精神評估，而精神科醫生寫給法庭的我拒絕評估是錯誤的！
I claim that what the psychiatrist did is a violation
of the Constitutional right to really believe in God! And I asked the Criminal Court to investigate
that on 13 July 2021! I'm very curious
whether they will agree that I must give up my faith in God, or If I can keep
my faith in God. Because, if I can keep
my faith in God, which means that I don't need a physical examination in order
to complete the court-requested mental assessment, then the letter from Jainan
Psychiatric Center (衛生福利部嘉南療養院) Dean Wu Wenzheng (院長吳文正)
dated 2 June 2021 is incorrect!

The letter dated 2 June 2021 from Dean Wu Wenzheng (院長吳文正)
states:
主旨：檢還108年度訴字第1170號被告HELMERICHS‧RENE（中文名：是瑞內）之鑑定卷宗資料，詳如說明，惠請查照。
Subject: Check and return the appraisal dossier data of
Defendant HELMERICHS‧RENE (Chinese name: Shi Rene) in the 108th v. No. 1170.

說明：
Description:
一、復貴院110年04月01日南院武刑歲108易1170字第1100011570號函。
1. Fuguiyuan's letter dated April 1, 2021, No. 110011570 of the
Nanyuan Military Penalty Years 108 Yi 1170.
二、本院安排於110年05月31日（星期一）執行鑑定，惟旨揭個案於鑑定當日拒絕接受檢驗科檢查項目（血液、尿液、腦波等檢驗檢查），並表示於在他國不須執行檢驗檢查項目，可直接由司法精神醫師進行評估會談，故拒絕本院之鑑定安排流程。
2. The hospital arranged for the appraisal to be carried out on
May 31, 110 (Monday), but it was announced that the case refused to accept the
laboratory examination items (blood, urine, brain wave and other examinations)
on the day of the appraisal, and stated that it was in another country. There
is no need to perform inspection and inspection items, and the forensic
psychiatrist can directly conduct the assessment meeting, so the appraisal arrangement
process of this hospital is rejected.
三、經本院審慎評估，個案拒絕配合鑑定流程項目，故檢還本案相關資料，以利轉由其他處所安排精神鑑定。
3. After careful evaluation by this court, the case
refused to cooperate with the appraisal process items, so the relevant
materials of the case were checked and returned to facilitate the transfer of
mental appraisal to other locations.
衛生福利部嘉南療養院院長吳文正院長和法醫精神科醫生李俊宏否認人們有信仰永恆心靈的權利是錯誤的。精神科醫生應該了解心理健康的來源，而不是進一步與來源分離。
